Applicant privacy notice

For California job applicants · Effective October 26, 2026

Modus Advanced, Inc. (“Modus,” “we”) collects personal information from people who apply for jobs with us. This notice explains what we collect, why, how long we keep it, and the rights California residents have under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA). It applies to information collected through this careers site and during our hiring process.

What we collect

  • Identifiers and contact details — your name, email address and phone number.
  • Professional and education information — whatever your résumé contains (work history, skills, education, certifications), any link you provide such as a LinkedIn profile, and the shifts you say you could work.
  • Hiring-process information — our notes from screening calls and interviews, results of any skills or job-fit assessment you take, messages between you and our recruiters, and summaries produced by the automated review tool described below.
  • How you found us — the job site or campaign named in the link that brought you to the application, when the link carries one.
  • Technical information — your IP address and information about your browser, used only to protect the form from automated abuse (including a bot check run by our hosting provider) and to limit repeated submissions. The counters tied to your IP address are deleted within a day.

We do not ask for sensitive personal information (such as your Social Security number, financial account details, health information, immigration status, or racial or ethnic origin) on this form. Please do not include it in your résumé. If you receive an offer, we will collect what employment requires at that point, with its own notice.

Why we collect it

  • To review your application and decide whether to move it forward.
  • To contact you about your application, schedule calls and interviews, and send assessments.
  • To consider you for other open roles you may fit.
  • To keep the records employment law requires, and to defend or respond to legal claims.
  • To keep the application form secure and prevent fraud and abuse.
  • To understand which job sites and campaigns bring us applicants.

Automated tools

We use AI tools to help our recruiters at two points:

  • Résumé review. A tool compares what a résumé shows against the written requirements for the role and summarizes what it finds. Your name, contact details and other identifying information are removed from the copy this tool reads.
  • Later in the process, if your application moves forward: tools help a recruiter prepare questions for your screening call and summarize the call and your materials for the hiring team. These steps work from your full résumé and our call notes.

No tool makes a decision. A person reviews every application and makes every decision about advancing or closing it. You can ask us questions about how your application was reviewed, ask for it to be looked at again, or request a reasonable accommodation at any point by contacting Stacy Willis, Head of HR at hr@modusadvanced.com.

Who we share it with

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose it only to:

  • Modus employees involved in hiring for the role, such as recruiters and the hiring manager.
  • Service providers that process it on our behalf under contract — for hosting and data storage, email delivery, bot protection, skills assessments, interview scheduling, and the AI tools described above. They may use it only to provide those services to us.
  • Government agencies, courts or others where the law requires it, or to protect our legal rights.

How long we keep it

We keep application records, including any automated-review results, for at least four years from your application or our hiring decision, whichever is later, as California employment law requires, and longer where a legal hold or claim requires it. We are putting automatic deletion in place for records past that period; until it is running, older records may be kept longer. You can ask us to delete your information at any time (see below). If you are hired, your application becomes part of your personnel file and is kept under our employee records practices. The counters tied to your IP address are deleted within a day.

Your rights

If you are a California resident, you have the right to:

  • Know and access the personal information we have collected about you, the categories of sources, the purposes, and the categories of recipients.
  • Correct inaccurate personal information.
  • Delete your personal information, subject to the records we are legally required to keep.
  • Limit the use of sensitive personal information. We do not use sensitive personal information for any purpose that would give rise to this right.
  • Not be retaliated against for exercising any of these rights. Asking will not disadvantage your application.

Because we do not sell or share your personal information, there is nothing to opt out of.

How to make a request

We respond within 45 days, and will tell you if we need up to 45 more.
